Terms of Use for Trivia Tribe Leader

Trivia Tribe ("the Company," "we," "us," or "our") provides the Trivia Tribe Leader mobile application (the "App"). By creating a host account or using the App, you agree to these Terms of Use. These terms constitute a legally binding agreement between you and the Company.
1. Host Responsibilities
- 1.1 You are provided with pre-written quiz questions and are responsible for verbally guiding participants through the quiz.
- 1.2 You must ensure proper internet connectivity as the service requires online access.
- 1.3 Only one login per account is permitted at any time.
- 1.4 User-Generated Content: The Company maintains a zero-tolerance policy for objectionable content. You may not use venue names or feedback fields to display offensive or illegal material. We reserve the right to terminate accounts that violate this policy.
- 1.5 Service Scope and Content Delivery: The App provides a digital quiz hosting platform. As part of your active plan, the Company provides:
- New Content: A minimum of two (2) new quiz sets per month. New content is loaded on the first and third Mondays of each month. The first Monday release will generally be a longer format quiz, while the third Monday release will generally be a short to medium format quiz. We reserve the right to adjust this schedule where necessary.
- Varied Formats: Quizzes may vary in length, difficulty, and theme at our discretion.
- Availability: New content is delivered digitally within the App. We reserve the right to modify the content schedule or quiz formats to improve the service.
- 1.6 Age Requirement: The account holder (Host) must be 18 years or older, as they are responsible for managing the account, payments, and compliance. Hosts may, at their discretion, allow younger individuals to present or assist with quizzes. Participants of all ages are welcome.
2. Plans & Payments
- 2.1 Plans are paid upfront in South African Rand (ZAR). Prices are subject to change, but you will be notified in advance of any material price increases.
- 2.2 Auto-Renewable Subscriptions: All plans are auto-renewable. Your subscription will automatically renew at the end of each billing cycle (e.g., monthly) unless you cancel it at least 24 hours before the end of the current period. Your App Store or Google Play account will be charged for renewal within 24 hours prior to the end of the current period.
- 2.3 Management & Cancellation: You can manage your subscription or turn off auto-renewal at any time by going to your Account Settings on the App Store or Google Play Store.
- 2.4 Refunds: Payments are processed through the App Store or Google Play. Refund requests must be directed to the respective store’s support (e.g., Apple's "Report a Problem"). The Company does not directly process or guarantee refunds for store-managed transactions.
- 2.5 Content Access: Active subscribers receive access to premium quiz content. If a subscription expires or is canceled, you will lose access to premium features at the end of the current billing cycle but will retain access to standard free content.
3. Venue Limitations
A 'Venue' is a single, unique physical commercial location, identified by name and suburb.
- Solo plan: 1 venue (changeable once per month).
- Trio plan: Up to 3 venues (changeable once per month).
- Fiver plan: Up to 5 venues (changeable once per month).
4. Service Availability
- 4.1 No 100% uptime guarantee due to internet and electricity (load shedding) dependencies.
- 4.2 The Company is not liable for service interruptions or business losses resulting from connectivity issues beyond our control.
5. Data & Content
5.1 Intellectual Property: Trivia Tribe (the Company) retains ownership of all platform technology, App code, and pre-written quiz questions.
5.2 Account Deletion & De-identification: When you delete your account, we will permanently de-identify your personal data in accordance with the Protection of Personal Information Act (POPIA). This means your name, email, and identifiers will be removed or scrambled so that your quiz history and host data can no longer be linked to you. This anonymized data may be retained for internal statistical and research purposes. Please see Section 9.3 regarding active subscriptions and account deletion.
5.3 Audio Content & Third-Party Rights The App provides access to various audio assets intended solely for the purpose of trivia identification and interactive gameplay ("Audio Content"). This Audio Content may include:
- Musical Snippets: Original master recording segments of commercially released musical works.
- General Sound Clues: Non-musical audio assets such as animal sounds (e.g., dog barks, pig grunts), nature recordings, foley, and sound effects.
5.4 Mandatory Venue Licensing (SAMRO & SAMPRA) [IMPORTANT NOTICE]: The broadcasting or playing of commercial music and sound recordings in a public or commercial setting constitutes a "Public Performance" under the South African Copyright Act.
- By using the App to host an event, you acknowledge and warrant that the physical venue in which the trivia event is held maintains valid, current, and fully-paid public performance licenses from both SAMRO (South African Music Rights Organisation) and SAMPRA (South African Music Performance Rights Association).
- These licenses must cover both the "Musical Work" (the composition and lyrics, via SAMRO) and the "Sound Recording" (the master audio recording, via SAMPRA). Trivia Tribe provides the playback interface only and does not provide public performance licensing for any venue.
5.5 Source References & Verification Quiz questions may include references to external sources used during the research and verification process. Please note the following regarding these sources:
- Single-Source Questions: Some questions may reference only one source. This does not indicate that the fact has not been cross-referenced or verified. In such cases, the single source may be the originating or official organisation, or the fact may be sufficiently well-established that multiple sources are not required. In some instances, a source is cited simply to provide a reference point.
- Accessed Dates: Where source links are provided, an accessed date will be displayed after the link (e.g., accessed 12 April 2026). This reflects the date on which the fact was verified against that source. Trivia Tribe is not responsible for sources that subsequently become unavailable, are removed, or are placed behind a paywall after the accessed date. The inaccessibility of a source after this date does not affect the validity of the verified fact.
- Link Review: Source links will be reviewed from time to time to check their continued availability. However, this will not occur on a fixed or regular schedule, and Trivia Tribe does not guarantee that all links will remain accessible at any given time.
6. Account Termination
We may terminate accounts immediately for:
- Payment fraud or chargebacks.
- Sharing login credentials.
- Violating platform security or User-Generated Content policies.
- Abusive behavior toward support staff.
7. Liability & Indemnity
7.1 Limitation of Liability Our total liability is limited to the amount paid for your current active plan. We are not liable for indirect damages, incidental losses, or venue-related business losses.
7.2 "As-Is" Service The App is provided on an "as-is" basis. We do not guarantee that audio playback will be uninterrupted or error-free in all venue environments or that Audio Content will be available at all times.
7.3 Licensing Indemnity You agree to indemnify, defend, and hold Trivia Tribe, its developers, and affiliates harmless against any legal claims, royalties, fines, or actions resulting from your failure to secure the appropriate SAMRO and SAMPRA licenses at your specific location of operation. Trivia Tribe shall not be held liable for any copyright infringement claims or legal disputes arising from your public performance of Audio Content.
8. Governing Law
- 8.1 These terms are governed by South African law.
- 8.2 In addition to these Terms, your use of the App is subject to the Apple Media Services Terms and Conditions (including the Standard EULA) or the Google Play Terms of Service, depending on your device. In the event of a conflict between these Terms and the store's terms, the store's terms shall prevail regarding billing and distribution.
9. Account Deletion and Access Recovery
- 9.1 Restore Purchases: If you switch devices, reinstall the app, or lose access to your premium features, use the "Restore Purchases" button in the App Settings to re-sync your active subscription to your device.
- 9.2 Account Deletion:
- In-App: Use the Delete Account option within the App Settings.
- Web: Visit triviatribe.co.za/delete-account to submit a request.
- 9.3 Critical Subscription Warning: IMPORTANT: Deleting your account is irreversible. Once your account is deleted, your data is de-identified, and we cannot "restore" your account or transfer remaining subscription time to a new one. You must manually cancel your subscription in your Store settings to avoid further charges.
10. Changes to Terms
The Company will notify you of material changes via email and update the "Last Updated" date on this page.
